A year after her daughter and grandchildren were murdered, Sally Sjaastad said the indescribable pain of their deaths hasn't begun to subside. She thinks about them first thing every morning and again as she struggles to get to sleep each night. And then she has nightmares about what she calls "that black night in November," when her daughter's husband murdered his family and attempted to burn down their house before shooting himself.
Mixed with the pain is the gnawing question of whether there was something she or anybody else could have done to prevent the tragedy. Mostly she is disappointed with a criminal justice system that seems to be unable to protect the victims of domestic violence.
People who threaten to kill themselves can be taken to a psychiatric hospital and forced to undergo treatment, Sally said, "yet you can threaten to kill someone else and they say, 'Well, they haven't done anything, so there's nothing we can do about it.
Her frustration is shared by those who work in the Domestic Violence Unit of the Billings city attorney's office. The trouble is that in Michelle's case, as in so many others, "ultimately, our hands are tied in what we can do i have to use illinois job link_ can't do," she said. Sally is also angry at what she said is the "pervasive attitudes of ambivalence and ignorance" that affect the way people in Billings and elsewhere in Montana deal with domestic violence.
She points to what she calls Gov.
Judy Martz's "outrageous" remark to a business group in Butte nearly two years ago. Martz reportedly said, "My husband has never battered me, but then again, I've never given him a reason to. She said Billings Police Chief Ron Tussing betrayed an ambivalent attitude when he told a newspaper reporter last January that "there isn't a lot you can do to prevent homicides.
Michelle was the second of Sally's three children, all girls. Michelle was only 14 when she met her future husband, Gordon Edward Mosure, known to everyone as Rocky. He was 10 years older than Michelle, but she told her mother he was It was easy enough to believe. Rocky was a small man, just 5 feet 4 inches tall, weighing barely pounds. But Sally thought even 17 was too old, and she wanted Michelle to stop seeing him. She didn't, and at the age of 15, on Jan. Kristy spent the first three months of her life in the hospital.
Michelle, who was attending Senior High School, went to feed her before school every day and rejoined her as soon as she got out. He also organized a mud brick stove construction program as part of community wood conservation efforts. In his most recent role as CFO of a local company, he led the implementation of a new financial system.

As a mechanical engineer, Jason spent the early part of his career designing HVAC, plumbing, lighting and power distribution systems for commercial buildings. He has created a priority for ensuring the smart implementation of environmentally sustainable techniques.Her husband, Rocky, had never made a threat, she said. She was to blame. He was a wonderful husband. A wonderful father.
The prosecutor, Stacey Tenney, later told me that she knew Michelle was lying. Of course she was lying. Just days earlier, Michelle, in an effort to obtain a restraining order, had for the first time completed an affidavit detailing what Rocky had done to her over the course of their decade-long relationship. The restraining order request was the first time Michelle had sought help.
Sally called the police, and Rocky was arrested. With Rocky in jail, Michelle finally worked up the courage to file for a restraining order.
So they bailed him out. Without her cooperation, there would be no case. That was in September Two months later, Rocky shot and killed Michelle. Then he fatally shot his two children, and then he turned the gun on himself. Domestic violence victims recant their testimony as much as 70 percent of the time, according to some estimates. They spent years building a movement for something called evidence-based prosecution, which kept a victim from having to take the stand against an abuser.
Then, in the early s, a Supreme Court case called Crawford v. Washington came along, and years of progress were placed in peril. Long before Michelle Monson ever met Rocky Mosure, an activist named Ellen Pence began promoting a new way to prosecute cases of private violence. Pence, who was based in Duluth, Minn. Very often abusers intimidate witnesses so thoroughly that they wind up not only recanting but also testifying for the defense. One court case I sat through detailed some of the more than recorded calls a perpetrator made to his partner over the course of three weeks.
In lateMs. Gwinn was intrigued by Ms. He returned home just in time to try his first evidence-based domestic violence case — against a sitting judge named Joe Davis. Davis was accused of beating his girlfriend; his girlfriend had fled to Mexico.
Gwinn decided to go forward with the case, using as evidence parts of the tape and her injuries. Local media followed the trial intensely. In front of a throng of television cameras, Mr. Gwinn lost. The case ended with a hung jury.
